• Quotes: All pricing provided via the Material Request Form or by phone is an estimate based on current market rates. Final pricing is confirmed at the time the order is officially placed by our sales team.
• Weight: Materials are sold by the ton. Final billing will be based on certified scale weights provided at the time of loading.

• Site Readiness: It is the customer’s responsibility to ensure the delivery site is accessible and clear of obstructions (overhead wires, low branches, vehicles, etc.).
• Curbside Delivery: Standard delivery is to the curb or a cleared, stable driveway.
• Property Damage Waiver: If the customer requests delivery beyond the curb (e.g., onto a driveway or into a backyard), M&S Aggregates LLC assumes no liability for damage to driveways, sidewalks, underground utilities (septic tanks, irrigation, etc.), or landscaping. The weight of delivery trucks can exceed 25 tons; the customer assumes all risk associated with heavy equipment entering the property.

• Natural Product: Aggregates, sand, and boulders are natural products. Variations in color, texture, and size are inherent and to be expected.
• Quality: We provide construction-grade materials. While we strive for consistency, M&S Aggregates LLC does not guarantee an exact match to previous loads or samples.

• Cancellations: Orders must be cancelled at least [24 hours] prior to the scheduled delivery time. Cancellations made after a truck has been loaded or dispatched will incur a restocking fee plus the full haul rate.
• Returns: Due to the nature of the product, all sales are final once the material is dumped. We cannot "pick up" or return material once it has been delivered to the job site.

• Due Dates: Payment is due upon delivery unless a Wholesale or Contractor Account has been established and approved in writing.
• Forms of Payment: We accept [Credit/Debit cards, local checks, and pre-approved contractor accounts].

• M&S Aggregates LLC shall not be liable for any delays in delivery caused by weather, traffic, equipment failure, or other circumstances beyond our reasonable control.
